§ 12.5-200. Civil nature of nuisance violations.

  • (a)

    The civil regulations of the abatement of nuisances within the unincorporated areas of St. Mary Parish shall be governed by the provisions of this chapter. Any nuisance violation prohibited by this chapter shall be a civil violation only, and no criminal penalty will be imposed for its commission. For purposes of this chapter, a nuisance violation is the violation of any provision of this chapter.

    (b)

    The provisions of this chapter shall in no way be viewed as an abrogation of the criminal enforcement provisions for littering and other such nuisances as provided for under state statutes, or in the ability of a law enforcement officer who in the course of his official duties witnesses an act in violation of the aforementioned statutes and issues a citation therefor.
