§ 14-8. Boat launch facilities; advisory committee.

  • (a)

    The parish council does hereby appoint a seven (7) member advisory committee for each region and does hereby designate their respective terms after which initial staggered term they may serve two (2) consecutive four-year terms.

    (b)

    The advisory committees shall meet and choose a chairman by majority vote.

    (c)

    Each advisory committee shall meet at least monthly, but may meet more often if deemed necessary. Each advisory committee shall elect a chairman who shall call and conduct all committee meetings. The chairman shall be elected annually by majority vote of committee members.

    (d)

    The advisory committee may make recommendations to the parish council for the operation, maintenance, construction, and usage of the parish-owned boat launching facilities. All recommendations shall be made by resolution passed by a majority vote of the committee.

    (e)

    Each advisory committee shall be subject to all the other laws and ordinances of the state and parish affecting the operation thereof, which presently exists or may hereafter be adopted, including the "open meetings" law.

    (f)

    A fee of $1.00 per vessel launched is hereby imposed at all boat launch facilities owned and/or operated by the parish and at which the parish appoints a caretaker as hereafter provided. The user fee is subject to the following rules:

    (1)

    All monies collected from the user fee shall be remitted to a special account created by the parish council;

    (2)

    Revenues from the special account so created can only be used to improve, maintain, and construct public boat launch facilities owned or operated by the parish council;

    (3)

    Each launch location shall maintain an individual account of revenues generated. The revenues can only be spent at the location where generated. However, revenues may be transferred for expenses at another launch location by a two-thirds (2/3) vote of the parish council;

    (4)

    No money collected in any particular year may be expended during that year. The money collected in one year can only be spent in the next or succeeding calendar years.

    Additionally, no person, firm or corporation shall park or cause to be parked any vehicle at or on the premises of any boat launch facility owned and/or operated by the parish without having first paid a fee of $1.00 per day for each day said vehicle is parked at such facility; in lieu thereof, such persons, firms or corporations may purchase an annual permit. Daily launch tickets are valid only for use at the location where purchased.

    (g)

    The caretaker shall have the right to place a single mobile home for him and his immediate family at boat launches subject to rules and regulations to be prescribed by the chief administrative officer of the parish. Except for the Quintana (Cypremort Point) Boat Landing, any boat launch facilities which do not have a resident caretaker will remain a free launch until such time as a caretaker is secured; the Quintana (Cypremort Point) Boat Landing shall be subject to the boat launch fee imposed herein.

    (h)

    All user fees, daily and annual, generated or earned through the implementation of this section shall be used, except as provided in subsection (f)(2) of this section, for capital improvements and maintenance programs other than general maintenance. It is the intent hereof that ordinary and usual maintenance of boat landing facilities shall be derived from other funds of the parish and not from the funds generated by or through the implementation of this section.

    Ordinary maintenance is defined as including, but not being limited to signage, garbage/trash pickup and disposal, grass cutting, parking lot upkeep, limestone or other fill materials for the parking lot, replacement of wooden planks on piers, utility cost, liability insurance cost, permit applications, publishing, and printing expenses.

    Capital improvements are defined to be improvements of a permanent nature and shall include the purchase and installation of surveyance cameras, purchase and installation of lighting fixtures, construction of new bulk heading, construction of new wharfs or docks, hard surfacing of parking areas.

    Provided, however, that the council may, by a majority vote, from time to time on an annual basis, rededicate funds so generated for the purpose of specific general maintenance items to individual boat launch facilities.
