§ 5-2. Building permit.

  • (a)

    Required. No individual, party, firm or corporation shall construct or cause to be constructed any building (residential, commercial, or otherwise) without first obtaining a permit to construct such building from the director of planning and zoning.

    (b)

    Conditions to issuance where flood hazard exists. A building permit shall be issued only after the planning and zoning director has determined that the proposed building site is reasonably safe from flooding or if a flood hazard exists, proposed new construction or substantive improvement (including prefabricated or mobile homes) must:

    (1)

    Be designed by or modified and anchored to prevent flotation, collapse, or lateral movement of the structure;

    (2)

    Use construction materials and utility equipment that are resistant to flood damage;

    (3)

    Use construction method practices that will minimize flood damage.

    (c)

    Subdivision plan review as to flood damage. Proposed subdivisions and plans therefor shall be reviewed to assure that:

    (1)

    All such proposals are constructed with the method to minimize flood damage;

    (2)

    All public utilities and facilities, such as sewer, gas, electrical, and water systems are located and constructed to minimize or eliminate flood damage; and

    (3)

    Adequate drainage is provided so as to reduce exposure to flood hazards.
