§ 13-2. Fireworks.

  • (a)

    Definition. Fireworks shall mean all roman candles, sky rockets with sticks, helicopter-type rockets, cylindrical fountains, cone fountains, wheels, illuminating torches and colored fire in any form, sparklers and dipped stocks, mines and shells, firecrackers of all types, whistles with report and items composed of a combination of two or more articles or devices of the items enumerated in this subsection, cherry bombs, aerial bombs, and torpedoes.

    (b)

    Possession, sale, use, prohibited. It shall be unlawful for any person in the parish to possess, sell, or use for any purpose whatever any fireworks as listed in subsection (a) of this section except as provided in this section.

    (c)

    Exceptions. Nothing in this section shall be construed as applying to the shipping, possession, and use of fireworks for public displays.

    (d)

    Permit required for public display. Any person proposing to hold a public display of fireworks shall first secure from the parish council a written permit to hold such display at least ten days prior to the date of display.

    (e)

    Nonapplicability of section. Nothing in this section shall be construed as applying to the possession, use, or sale of signals necessary for the safe operation of railroad crossings or other public or private transportation or of illuminating devices for photographic use.

    (f)

    Penalty for violation of section. Whoever shall violate the provisions of this section shall be punished by a fine of not more than $100.00 or imprisonment for a period of 30 days, or both.
