§ 13-6.1. Designated smoking areas within parish buildings and designated no smoking areas.

  • (a)

    A designated smoking area within a parish building shall consist of a room that has a separate air ventilation system, so that no smoke shall be able to enter the main air condition systems. If said room is not present, or is not feasible to place in a parish building, there will be "no smoking" in said building.

    (b)

    Notwithstanding the provisions of the above subsection (a), there shall be "no smoking" allowed (1) within the entire courthouse square of the St. Mary Parish Courthouse. This area shall include the entire courthouse building and all outside areas within the boundary of the courthouse square consisting of Main Street, Willow Street, Teche Drive and Wilson Street; and (2) the entire area across the courthouse square bordering Willow Street, Main Street and Teche Drive known as the "Blevin's Property". This area shall include all parking areas, the entire Blevin's building, the entire Save Our Children Mentoring Program building and the old Tiger Den building.

    (c)

    Any violation of this ordinance shall be cited by a law enforcement officer by the issuance of a citation and summons to appear before a court of proper jurisdiction, and shall by itself not be grounds for an arrest or for a full search of the person cited.

    (d)

    Any and all person or persons found in violation of any provision of this section shall, upon conviction thereof, be fined not more than $50.00 for the first offense, $100.00 for the second offense, and $100.00 and 16 hours of community service for the third and subsequent offenses.
