§ 17-61. Variance from provisions of division.

  • Any applicant for a permit under this division who feels that there are unnecessary hardships or severe difficulties involved in complying with these provisions and whose permit has been refused, may apply within 15 days after being notified of such refusal to the parish council for a variance from the requirements of this division. A variance shall be issued solely at the discretion of the parish council. A variance shall only be issued upon:

    (1)

    A showing of good and sufficient cause;

    (2)

    A determination that failure to grant the variance would result in exceptional hardship to the applicant;

    (3)

    A determination that the granting of a variance would not have the effect of nullifying the intent and purpose of this article.
