§ 17-134. Types of permit.

  • (a)

    Siting permit. A siting permit must be applied for at the time of initial planning for the facility and before construction begins; the applicant will be required to demonstrate that the facility will comply with the criteria established herein. All facilities which are considered to have been in existence prior to the effective date of this article are exempted from application for a siting permit unless the business or the site changes ownership, process or name.

    (b)

    Renewal permits. All facilities regulated herein as a facility which began operations subsequent to the effective date of this article must renew their siting permit annually from the date of final initial permit approval. The applicant will be required to demonstrate that the facility and its operation continue to comply with requirements of this article.

    (c)

    Permit action. The permit may be modified, revoked and reissued, or terminated for cause. The filing of a request by the permittee for a permit modification, variance, revocation and reissuance, or termination, or a notification of planned changes or anticipated noncompliance, does not stay any permit condition.
